How to Obtain Legal Documents You have Lost
How to obtain lost documents that are required before you can legally marry
There are certain documents Marriage Celebrant legally must sight before legally being able to perform your marriage ceremony. I have put the web address and phone numbers of each state Registry below.
1) Birth Certificates:
You will need to enquire at the Registry office in the state you were born in, alternatively they all have forms you can download.

2) Divorce documents:
If you require another copy of a sealed divorce certificate (decree nisi/absolute) you need to contact the Family Court of Western Australia
- Written request to the court via form you can obtain from this link. http://www.familycourt.wa.gov.au/_files/Request_for_Documents_Jun08.pdf
- Post the form to Family Court of WA, GPO Box 9991, Perth WA 6848
- or Fax the form to 08 9224 8360
- Supply parties names, file number, address, contact telephone number.

Note: If you intend to register the divorce certificate with an overseas government agency, you may require the divorce certificate to be authenticated or apostilled. You will have to arrange this with the Department of Foreign Affairs and Trade. Further information is available about this procedure at website www.smartraveller.gov.au
3) Death Certificate:
See below for the contact details of each States Registry Office. You will need to contact the State office where the person passed away.

5) Persons Born Overseas and unable to obtain a Birth Certificate and don’t have an Overseas Passport:
If you genuinely are unable to obtain the documents, then you can complete a Statutory Declaration giving specific reasons why the documents are not available; have the Declaration witnessed and give it to the Celebrant instead of the documents.
